Mandatory Minimum Sentences and Adult Prosecution of 15, 16 and 17 Year Old Offenders

Oregon voters approved in November 1994 to apply mandatory minimum prison sentences to certain crimes against person committed on or after April 1, 1995 with no possibility for any reduction in sentence, such as for good behavior.  Although legislation has modified this statute several times, if you commit one of the crimes below you will be sent to a Youth Correctional Facility for the time listed.

These are examples of Measure 11 crimes that will send you to a Youth Correctional Facility:

ROBBERY I:
You use a baseball bat, a gun, or a knife against someone to steal their bike. You will go to a Youth  Correctional Facility and be there for 7 years, 6 months.

ROBBERY II:
You tell someone you have a gun and to give you their money. The person believes you have a gun, even if you don’t, and gives you their money. You will go to a Youth Correctional Facility and be there for 5 years and 10 months.
 

SEXUAL ABUSE I:
You are babysitting or playing with a small child who is 3 years or more younger than you. You have sexual contact with them by touching their penis, vaginal area, or anus, or by making them touch you in those same places. You will go to a Youth Correctional Facility and be there for 6 years and 3 months.

ASSAULT II:
You physically injure someone on purpose with a gun, a knife, a bat, or some other weapon. You will go to a Youth Correctional Facility and could be there for 5 years, 10 months.

 

FOUND GUILTY OF ANY OF THESE 24 MEASURE 11 CRIMES YOU WILL DEFINITELY GO TO YOUTH CORRECTIONAL FACILITY AND YOU COULD STAY THERE FOR:

  • Compelling Prostitution
  • Robbery II
  • Assault II
  • Kidnapping II
