Records

Pursuant to ORS 419A.255 and 419A.257

Record of the case includes:  summons and other process; petitions; papers in the nature of pleadings, answers, motions, affidavits, and other papers that are filed with the court (dispositional reports), including supporting documentation; local citizen review board findings and recommendations; guardian report summaries filed with the court; order and judgments of the court,  including supporting documentation; transcripts; exhibits and materials offered as exhibits whether or not received in evidence; and other documents that become part of the record of the case by operation of law.

The record of the case shall be withheld from public inspection but is open to inspection by the following:

  • Judge of the juvenile court and those acting under the judge’s direction;
  • The youth;
  • The parent or guardian of the youth;
  • The parent ad litem for the parent;
  • The surrogate;
  • A person allowed to intervene in a proceeding involving youth;
  • Service providers in the case;
  • Court Appointed Special Advocate;
  • The attorneys or prospective appellate attorneys for any of the person listed;
  • The District Attorney’s office;
  • The Juvenile Department;
  • Department or Human Services;
  • Oregon Youth Authority

The following are entitled to copies of the record of the case:

  • The judge of the juvenile court and those acting under the judge’s direction;
  • The parent ad litem for the parent;
  • A party to the extent permitted under 419C.285(2)
  • Adjudication Stage: (Citation/Petition/Motions filed with the Court) youth
  • Dispositional Stage: (dispositional report, court orders) youth, parent/guardian, an intervener who petitions or files a motion on the basis of the youth or parent.
  • Service providers in the case;
  • Court Appointed Special Advocate;
  • Attorneys or prospective appellate attorneys for any of the person listed;
  • District Attorney’s office;
  • Juvenile Department;
  • Department of Human Services;
  • Oregon Youth Authority
