Jackson County and the City of Medford are pursuing several projects that will make improvements to Foothill Road from Hillcrest Road to Highway 140 over the next 5 years.  Like many other old historical roads, the right-of-way for Foothill Road is not well documented (the road was established in 1869).  The Oregon Revised Statutes (ORS) has a process by which County governments can fully document the right-of-way location when such circumstances exist. The process is called "Legalization" and is covered by ORS 368.201 through 368.221.

 

To ensure clarity for all property owners, for the City of Medford and for Jackson County, currently we are pursuing this legalization process on Foothill Road from Lone Pine Road to Delta Waters Road.  Attachments to this article include a full draft survey of the legalization which shows all existing monuments and how the proposed right-of-way fits these monuments.  These documents are also available for viewing at the Jackson County Roads office, 200 Antelope Road, White City.

 

The Jackson County Board of Commissioners will hold a public hearing to take input on this proposed legalization on Wednesday, July 8, 2020, at 9:30 AM.  During the COVID-19 global pandemic, the Board of Commissioners will be hosting their meetings via videoconference/webinar. Because of physical distancing requirements, to address the Board of Commissioners under Request for and Discussion of Non-Agenda Items and/or a Public Hearing, the public is encouraged to submit comments in writing, either by mail to 10 South Oakdale, Room 214, Medford OR 97501, or by email to BoC‑CAO_Admin@jacksoncounty.org; written comment must be received by 8:30 a.m. on Wednesday, July 8, 2020, to be accepted into the meeting record.  All written correspondence must include the author’s name and address.  Live audio comment via videoconference may also be received during the public hearing portion of the meeting by emailing BoC‑CAO_Admin@jacksoncounty.org to register; registration requests must be received by 8:30 a.m. on July 8, 2020.  To speak in person during a public hearing, the public may come to the Courthouse Auditorium; occupancy is limited in the Auditorium and you may be asked to wait outside until it is your turn to speak.  Following the public hearing, the Board will act on the legalization where they can approve the proposed right-of-way as presented, make changes and approve it, or deny it.

Please note this legalization process is NOT dealing with any impacts from proposed construction projects on Foothill Road.  This process is to simply establish where we think the right of way is today.
